Terms & Conditions
By creating, participating in, or interacting with a raffle on XElementia HUD Raffles (the “Platform”), you agree to these Terms & Conditions (“Terms”).
1) Definitions
- Raffle: a blockchain-based raffle configured through the Platform.
- Creator: user who configures and deploys a raffle.
- Participant: user who purchases raffle tickets.
- NFT: the digital asset escrowed for raffle settlement.
- BASC Pool: total BASC tokens collected from ticket purchases for a raffle.
- Pending Escrow: raffle created but not live until escrow lock/activation is completed.
- Live: raffle active for ticket purchases after successful escrow activation.
2) Eligibility & Compliance
- You represent that you are legally permitted to use this Platform in your jurisdiction.
- You are solely responsible for compliance with applicable gambling, lottery, tax, consumer, and digital-asset laws.
- You are responsible for your wallet, private keys, and transaction approvals.
The Platform does not provide legal, tax, or financial advice.
3) Nature of the Service
- The Platform provides tooling and interfaces for blockchain raffle execution.
- The Platform is not a bank, broker, exchange, custodian, or financial advisor.
- Transactions are blockchain operations and are generally irreversible once confirmed.
4) Lifecycle, Finality & Execution
- A raffle may exist in Pending Escrow before becoming Live.
- Once Live, a raffle cannot be canceled or paused by the Creator.
- NFT settlement and winner outcome are determined by deterministic on-chain state and logic.
- Operational automation may execute closure/settlement steps (delivery, payout, burn) when conditions are met.
5) Economics & Fees
- Creator payout: 95% of BASC Pool.
- Protocol burn: 5% of BASC Pool.
- Creation fees, per-ticket platform fees, and network fees may apply and are displayed in the flow.
- Unless required by law, paid on-chain fees are final and non-refundable.
6) Technical & Operational Risks
- Blockchain congestion, RPC failures, wallet/provider outages, indexing delays, and smart-contract risks may affect timing and UX.
- No guarantee is made regarding uninterrupted service, exact timing, raffle fill rate, profitability, or NFT market value.
7) Wallet & Signature Responsibility
- You must verify destination addresses, amounts, and prompts before signing.
- Loss of private keys, incorrect approvals, or compromised wallet environments are your responsibility.
8) Prohibited Conduct
- Unlawful activity, fraud, manipulation, sanctions evasion, and abuse of protocol mechanics are prohibited.
- The Platform may restrict access or actions where required for security/compliance reasons.
9) Limitation of Liability
To the maximum extent permitted by law, the Platform is provided “as is” and “as available”, without express or implied warranties. The Platform is not liable for direct, indirect, incidental, or consequential losses related to blockchain transactions, smart contracts, wallets, or third-party infrastructure.
10) Updates & Re-Acceptance
- These Terms may be updated with a new version and effective date.
- Notice may be provided through in-app modal/banner and this legal page.
- New versions may require explicit re-acceptance before creating new raffles.
11) Governing Law & Jurisdiction
These Terms are governed by the jurisdiction designated by the Platform’s legal entity or official legal documentation. Where mandatory consumer protections apply by law, those protections remain in force.
12) Acknowledgment
By using the Platform, you acknowledge that you understand blockchain and wallet risks, have reviewed these Terms, and accept responsibility for your actions.
